Half of all Treasure Coast residents choosing cremation

More than a third of the 2.5 million Americans who die this year likely will be burned in crematories rather than buried in caskets. And in Florida and the Treasure Coast, one of every two people is choosing cremation. Two of the factors driving the nation’s rapid increase in cremations — lower costs and a mobile society — are particularly pertinent on the Treasure Coast, funeral directors said, especially in the bad economy. “(Families) are making tough decisions to do the best they can with limited resources to take care of the final disposition of their loved ones, to be respectful, and to take care of the living as well,” said Richard Haisely, owner of Haisley Funeral Homes. The percent of bodies cremated first reached double digits in the 1980s, according to the Cremation Association of North America. The group estimates cremation will account for the disposition of nearly 60 percent of all bodies in 2025. “The increase in the cremation rate is the most significant change in U.S. mortuary customs in the past 50 years,” said Thomas Lynch, a funeral director in Michigan since 1974. Cremation costs less than burial. It suits a more mobile society and is considered more environmentally friendly. But cultural and spiritual factors also play a role in choosing cremation, said Stephen Prothero, a professor of religion at Boston University. States with higher rates of church attendance generally have lower rates of cremation, according to a statistical analysis by Scripps Howard News Service. Utah, for example, has the highest participation rate in organized religion, according to the Association of Statisticians of American Religious Bodies, and one of the lowest cremation rates, at only 23 percent. Conversely, Oregon has the lowest religious participation rate and one of the nation’s highest cremation rates, at 65 percent. Among Christians, by far the largest religious group in America, cremations are increasing. Many Christians are coming to view themselves in a more spiritual and less physical way, Prothero said. They find the process of cremation and the rituals with ashes, whether scattered or kept in an urn, more appealing. This trend holds true on the Treasure Coast, Haisley said. People often opt for cremation after a traditional memorial service, but regardless of the final disposition of the body, Haisley said people are paying more attention to the memorial service. “More people are turning to just meaningful ceremonies with more people involved,” Haisley said. “It’s not just a minister — who in some cases might not have even known the loved one.” Florida is one of 13 states, including Alaska, California, Vermont and Hawaii, where cremation accounts for between 50 percent and 68 percent of all deaths. But despite the increasing popularity of cremation, many Americans remain squeamish about the actual process, which involves incinerating the body at temperatures up to 1,800 degrees. According to funeral directors and cemetery managers around the country, customers rarely are as willing to witness the process of cremation as they are to view a burial. “At some level, we are not as comfortable with fire and we are with earth burial,” said Lynch, author of the award-winning book “The Undertaking.” “We do not witness cremation in the same way that we witness burial, and I think that is a sign of some kind of disconnect.” CREMATION FACTS Common in the ancient world, cremation didn’t get much public attention in the United States until 1876 when the cremation of Baron Joseph Henry Louis Charles De Palm set off a scientific debate. Pro-cremationists said the practice was more sanitary than burial, an argument that fell apart when scientific evidence proved otherwise in the early 1900s. Cremation was statistically insignificant in America until the 1960s, when the numbers began to grow. It Is Time To Prepare Your Living Trust, Will And Powers Of Attorney

The Los Angeles Times ran an article on March 7, 2010 by Kathy M. Kristof in the personal finance section discussing the need to either amend your existing living trust or have one prepared along with a will, durable power of attorney for property management and an advance health care directive. Here is what the Times said: If you're rich, the best estate planning advice would be to die quickly. If you're not, the best advice is to either review or rewrite your estate planning documents to make sure your heirs aren't left high and dry if you die. That's because estate taxes that could allow Uncle Sam to nab up to 45% of your bequeathed assets are currently -- and very temporarily -- kaput. A decadelong phase-out of the estate tax eliminated the tax completely as of January. The catch: If nothing's done, estate taxes will boomerang back to historic levels in 2011. That means any bequest of more than $1 million would be hit with a heavy levy on any amount above that limit after December. But estate planning isn't just about taxes, and it's not just for the rich. The legal vacuum that was created by the temporary elimination of the estate tax has created potential pitfalls even for people with modest estates. For example, if you were to die this year and had an old "by-pass" trust, the elimination of the estate tax could cause you to accidentally disinherit your spouse, said Clay Stevens, director of strategic planning for Aspiriant, a wealth management firm in Los Angeles. These trusts, aimed at reducing estate taxes, often have boilerplate provisions for bequeathing children an amount equivalent to the estate tax "exclusion." This year, that exclusion is unlimited, so everything goes to your kids and unintentionally there would be nothing left for a spouse, he said. Then, too, as long as the estate tax is phased out, so is something called the "step-up" that reduced capital gains taxes on your appreciated assets after you died. You can still get that break if you make a few strategic fixes to your estate plan this year, Stevens said. But, if you do nothing, your heirs could face capital gains taxes on all but a pittance of your appreciated property. "This is the one year when you can't procrastinate," said Herbert E. Nass, a New York lawyer and author of "101 Biggest Estate Planning Mistakes." "Absolutely everyone should review their documents." What if you have no documents? Then get cracking. Studies indicate that the vast majority of Americans don't have wills, trusts or powers of attorney. That can leave heirs in a rough spot, said Danielle Mayoras, coauthor with her husband, Andy, of "Trial & Errors: Famous Fortune Fights." Act now, avoid trouble later Ignoring your estate plan can land your children with ill-suited guardians or give them a pile of cash that they're too young to handle, she said. If you become incapacitated before you die, it can mean that your care could be dictated by a stranger -- or even an enemy. And, doing nothing can cause your heirs to bicker and battle in court -- sometimes for decades. "People never think their family is going to end up fighting," Andy Mayoras said. "But, especially in this economy, families are fighting over money more and more." Nass contends that neglect of an estate plan may have cost one wealthy New Yorker his life. Wall Street titan Ted Ammon, in the throes of an acrimonious 2001 divorce, was killed by his estranged wife's boyfriend, Nass said. The boyfriend went to prison, but the estranged wife got the estate because Ammon hadn't yet changed his will. "That was big news out here for a long time," he said. What do you need? First and foremost you need a will, which distributes your assets at death. Wills can be simple -- a matter of a few paragraphs -- or very complex. It depends on your wishes and whether you expect to draw up additional documents, such as a trust. If you don't want a trust, your will should name personal guardians for any minor children, economic guardians who can distribute assets to your children and other heirs, and an executor who will make sure the terms of the will are carried out. Finally, it should include a simple statement about what you own and who should get it. If you're leaving assets through a will, it's wise to also execute powers of attorney for both financial and healthcare matters, Stevens adds. That will give somebody you trust the ability to pay your bills and make medical decisions for you if you become incapacitated before you die. But if you want your heirs to be able to avoid probate -- a time-consuming and costly legal process that involves a court reviewing the distribution of assets bequeathed through a will -- you'd be better off to also create a trust. If you have a trust, your will essentially can be a one-liner: "I want all my nonretirement assets to go into my trust." (Retirement accounts such as IRAs should be left directly to people, not trusts. That gives your heirs the ability to withdraw those assets, and pay taxes on them, over a longer period of time.) A trust would then distribute the assets based on the formula you'd drawn up. Trusts can accommodate difficult issues, such as whether you want to attach a few strings to your bequests as you might if you're leaving assets to heirs who are not financially or personally responsible. Divide and conquer . . . the IRS Trusts also typically contain clauses that dictate who would handle your financial affairs should you become unable to handle them yourself. And many include a "by-pass" or a "two-step" provision that essentially splits the trust in two. Splitting the trust is aimed at saving estate taxes. That's because husbands and wives can leave each other all their assets without tax consequences, but if they want to leave money to anyone else, any amount over a set threshold is subject to tax. The amount that's "excluded" from estate taxes has been a moving target for the last 10 years, but is unlimited today and likely to amount to $1 million in 2011. As a result, savvy couples with estates in excess of $1 million (in any year but 2010) would each execute a by-pass trust, leaving the amount of the estate tax exclusion to their kids or other heirs and the rest to their spouse. That would preserve the estate tax exemption for the spouse who is the first to die. In the case of someone with $2 million in assets, that could save heirs a tidy $550,000 -- or 55% of the second $1 million. But the most important thing may be to simply make your wishes known so your heirs know that you've thought about them and how you'd like to provide for them when you're gone. That alone could eliminate a lot of family bickering. Both Nass and the Mayorases wrote books about what celebrities have done wrong with estate planning. They say they did so to give parents and their children a way of bringing up the topic to explore how they could do it better. "It's a way to get the dialogue started," Andy Mayoras said. Danielle Mayoras adds that entertainer Ray Charles' estate plan provides a blueprint of how to do it right. Andy Whitfield Diagnosed with Non-Hodgkin's Lymphoma

Non-Hodgkin's lymphoma (NHL), which is more common than Hodgkin's lymphoma, is cancer of the cells of the lymphatic system. When one has NHL, then cells in the lymphatic system grow without order or control or old cells do not die normally. NHL is a far-reaching disease and can occur in a single lymph node, a group of lymph nodes or an organ. It can also spread quickly to almost any part of the body. Whitfield, 35, doesn't seem distressed. "I'm receiving excellent care, and am feeling strong, positive and determined with an army of support behind me," the star told EW.com. Symptoms of non-Hodgkin's lymphoma include a painless swelling of the lymph nodes in the neck, underarm or groin. Patients are also likely to experience an unexplained fever, night sweats, fatigue, weight loss and itchy patches on the skin. 'LOST' Recap: Season 6, Episode 7 - Dr. Linus

The final season of LOST has begun! Last night's episode focused on Benjamin Linus and provided us with, possibly, the most exciting, fascinating, and revealing hour of the show to date. Will the other castaways learn that Ben killed Jacob? Will Ben be forced to deal with his horrendous past on the island? And what else do we learn about what the heck is going on? There's only one way to find out! I'll just start off with this statement: Last night's episode, "Dr. Linus," was easily the best of season 6 and one of my top 10 episodes of the entire series. It was riveting and revealing and contained two of my favorite monologues from the show as well. The episode began with an introduction to sideways-flash Dr. Linus, who teaches European history in California. Note that he teaches at a high school where Dr. Artzt works and where Locke is substituting! (PS: I am loving how interwined all their lives are becoming in these flash-sideways.) Ben's flash amplified his main problem: selfish manipulation. We learn that his best student is no other than Alex Rousseau, but she's not his daughter in this version of events. And through his History Club sessions with her, he learns that the person he despises most, the school principal, is having an affair with a nurse. And this presents an interesting predicament for Ben. After using Dr. Artzt to hack the nurses email, he realizes he can manipulate another person to get what he wants: the job as principal. However, when he does pull this off, it backfires. Alex has asked the principal to write her a letter of recommendation for college. And the principal will not write this if Ben decides to go ahead with his bit of blackmail. This directly parallels events on the island, as Miles outs Ben as the killer of Jacob and Ilana chains him to a tree and forces him to dig his own grave. When Fake Locke/Man In Black/Smokey provides a channel of escape to Ben, he attempts to flee, but, given the chance to shoot Ilana and join Locke's forces, he doesn't. And both timelines converge when Ben, for the first time in the entire series, chooses to save someone else and accept the responsibility of his actions. Ben's redemption as a "good" person was incredibly moving to me, most especially when he broke down in front of Ilana about the truth behind his motivations for everything he's done since season 2. He was losing his power, the power the Island and Jacob gave him, and he just wanted to be desired. And in an even more emotional moment, Ilana accepts Ben back. And, while all of this was wonderful, emotional, and incredibly written, it still wasn't the best part of the episode! Which is why this ruled so much. Because episode 7 marked the return of two dudes I want to know more about. And we got so much information about one of them! Guys, guys, GUYS. How fucking absolutely phenomenal were all the scenes with Richard, Hurley, and Jack? We got absolute confirmation that Richard came to the Island on the Black Rock, that he was most likely a slave (FROM EGYPT????), and that Jacob touched him and gave him a gift that not only prevents him from again but PREVENTS HIM FROM KILLING HIMSELF. Which lead to this scene: Richard's monologue preceeding this, in which he nearly started crying about losing Jacob and losing his chance to know what Jacob's plan for him was, was SPECTACULAR BEYOND WORDS. MORE RICHARD ALPERT. FOREVER AND EVER. Also please come make out with me ok thanks. I was totally amazed that Jack ALSO cannot die, which is only mildly disappointing because how awesome would it be if the main character totally died right now? I am a genius Y/Y? But yeah. Who still thinks Jacob is a good guy? Because OH MAN, he is DESTROYING EVERYONE'S LIVES. Any other thoughts or things I missed? I am so excited to see how this pans out.
